Facts: YK pulled over by police at 3:08 am but he report produced by the officer showed that no breath demand was provided to YK until 4:14 am. Decision: “Since there is no information to show why this much time passed between the time of driving and the demand, I cannot be satisfied that the demand was issued as soon as practicable”. Driving prohibition not instituted, no fine imposed. (August 2010).
