What Types Of Driving Prohibitions Exist In British Columbia?

There are a variety of different types of driving prohibitions that can be issued in British Columbia that will completely restrict your ability to drive within the Province of British Columbia for a period of time.  These prohibitions usually follow a police investigation regarding a driver’s suspected alcohol or drug consumption and the use of approved screening devices and/or police station breathalyzers.   The following is a short (non-inclusive) list of the most common types of driving prohibitions:

(a)       24 hour driving prohibition under section 215 of the Motor Vehicle Act;

(b)      Immediate Roadside Prohibition (IRP) under section 215.41 of the Motor Vehicle Act;

(c)       Administrative Driving Prohibition (ADP) under section 94.1 of the Motor Vehicle Act; or

(d)      Court imposed driving prohibitions under section 98 or 99 of the Motor Vehicle Act or section 259 of the Criminal Code;

If you have received any one of the above driving prohibitions then your driving privileges are either at risk of being prohibited or indeed already prohibited.  In the case of an IRP or ADP or 24 hour prohibitions you need to act swiftly (and within 7 days of being served same) in order to prevent your driving prohibition from continuing or appealing same.

In British Columbia the law regarding driving prohibitions is by far the strictest and most complicated in Canada.   Depending upon which FORM of driving prohibition that you have received there are different risks involved for the person served or issued the driving prohibition and steps that must be undertaken to appeal.
